By accessing or browsing this website, submitting an inquiry, or purchasing equipment or services from us, you agree to be bound by these Terms. If you do not agree, you must cease using the Site and our services immediately.
1. About Us & Scope of Services
Allround Vending Pty Ltd operates under the brand name M Series as a supplier, distributor, and service provider of commercial vending solutions, including:
- Direct sale of smart vending machines (ambient, snack & drink combinations, wall-mounted, and frozen units).
- Free fully-managed/placement vending services (machine placement, stocking, restocking, remote monitoring, and maintenance).
- Vending hardware parts, payment gateway integration (Nayax, telemetry, cashless systems), technical repairs, and delivery services.
2. Website Use and Inquiries
- Accuracy of Information: We strive to keep machine specifications, dimensions, features, and imagery accurate and up to date. However, technical updates and minor manufacturing alterations may occur without notice.
- Quotes & Orders: Submitting a contact form, request for a quote, or email inquiry does not constitute a binding contract. A binding contract is formed only upon our formal acceptance of an order, signed placement agreement, or receipt of payment/deposit pursuant to an issued Tax Invoice.
- Prohibited Activities: You agree not to misuse the Site, introduce malicious code, engage in data scraping or unauthorized extraction, or interfere with the functionality of the Site.
3. Machine Sales, Quotations, and Payment
- Pricing & Taxes: Unless stated otherwise, all prices quoted on the Site or on formal quotes are expressed in Australian Dollars (AUD) and are exclusive/inclusive of Goods and Services Tax (GST) as specified on the relevant quote or invoice.
- Payment Terms: Full payment of the purchase price or an agreed deposit must be cleared prior to dispatch or scheduled delivery, unless formal credit arrangements have been pre-approved in writing.
- Payment Gateways & Surcharges: Payments via credit card, EFTPOS, direct transfer, or third-party digital payment methods may be subject to standard merchant handling fees and processing terms.
4. Delivery, Title, and Risk
- Delivery Scope: Delivery is serviced via company-operated transport across metropolitan Victoria and via third-party freight partners interstate across Australia.
- Access Requirements: The purchaser/client is responsible for ensuring clear and level access for delivery (including checking doorway dimensions, lift weight limits, stairs, and clear pathway widths for bulky heavy equipment). Re-delivery or special hoisting fees resulting from inadequate site access will be billed to the customer.
- Risk & Title:
- Risk in the goods passes to the purchaser upon handover at the delivery address or upon collection by the customer’s carrier.
- Legal title and property in the goods remain with Allround Vending Pty Ltd until the full invoice balance is paid in cleared funds.
5. Free Machine Placement & Commission Programs
Where machines are installed under our Fully Maintained / Free Vending Machine arrangement:
- Ownership: The vending machine, telemetry systems, and stock remain the sole property of Allround Vending Pty Ltd at all times.
- Premises Access & Power: The site host agrees to provide uninterrupted electrical supply, standard internet/cellular connectivity (where needed), and reasonable access during business hours for restocking, auditing, and maintenance.
- Incentive Commissions: Commission payments (if formally agreed upon for high-volume sites) are calculated solely on verified net sales data from our telemetry monitoring systems and are paid out as stipulated in your individual placement agreement.
6. Australian Consumer Law (ACL) & Warranties
- Statutory Guarantees: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be lawfully excluded.
- Manufacturer / Commercial Warranty:
- Unless stated otherwise, new M Series machines come with a 12-month standard warranty covering manufacturing defects on parts nationwide, and labour within metropolitan Victoria.
- Exclusions: The warranty does not cover defects or damage caused by:
- Vandalism, physical impact, liquid damage, or user abuse.
- Power surges, improper voltage, or faulty site electrical wiring.
- Unauthorised modifications, repairs by third-party technicians not certified by us, or use of non-compliant consumables.
- Normal wear-and-tear items (e.g., cosmetic scuffs, globes, routine key replacements).
- Remedies for Commercial Purchases: To the maximum extent permitted by law, where goods or services are not acquired for personal, domestic, or household use, our liability for breach of a non-excludable condition or guarantee is limited, at our option, to:
- Replacement of the goods or supply of equivalent goods;
- Repair of the goods;
- Payment of the cost of replacing the goods or acquiring equivalent goods; or
- Supplying the services again or paying the cost of having the services supplied again.
7. Telemetry, Cashless Systems, and Third-Party Providers
- M Series machines integrate cashless payment readers (such as Nayax) and remote inventory monitoring modems.
- These systems rely on third-party mobile telecommunication networks and financial merchant processors. Allround Vending Pty Ltd is not liable for temporary service interruptions, network downtime, carrier dropouts, or bank settlement delays beyond our direct control.
